Terms of Service

These Terms of Service (the "Terms") govern your access to and use of FaceSwapGif websites, face swap tools, accounts, generated outputs, and related services (the "Service"). By accessing or using the Service, you agree to these Terms, the Privacy and Cookies Policy, and the Content Policy. If you do not agree, do not use the Service.

Eligibility and accounts

You must be at least 18 years old and legally able to enter into these Terms. If you use the Service for an organization, you represent that you have authority to bind it.

You must provide accurate account information, protect your credentials, and promptly tell us about suspected unauthorized access. You are responsible for activity performed through your account unless applicable law provides otherwise. You may not sell, transfer, automate access to, or share an account in a way that defeats usage limits or security controls.

The Service

FaceSwapGif provides tools that process user-supplied media with configured third-party AI providers. Results may vary, take longer than expected, fail, contain artifacts, or be unavailable. Features, limits, models, providers, output formats, and beta functionality may change, but changes do not remove rights that applicable law makes mandatory.

Do not rely on the Service or generated output for identity verification, evidence, medical or legal decisions, public safety, or other high-impact decisions.

Your content and permissions

You retain the rights you already hold in content you upload. You grant FaceSwapGif a limited, non-exclusive, worldwide license to host, copy, transmit, transform, display to you, and otherwise process that content only as reasonably necessary to operate, secure, support, and enforce the Service.

You represent and warrant that:

• you own the uploaded media or have all licenses and permissions needed to use it;
• every identifiable person whose face or likeness is used has consented to the intended face swap and its planned use;
• your uploads, instructions, outputs, and sharing do not violate law, privacy, publicity, intellectual-property, contractual, or other rights; and
• the information you provide with reports or support requests is accurate to the best of your knowledge.

Permission to access material online does not by itself give you permission to use a person's face or copyrighted media in a face swap.

Content Policy and prohibited use

The Content Policy is part of these Terms. It prohibits, among other things, non-consensual face use, content involving minors, sexual or intimate content, impersonation, fraud, harassment, deceptive political content, rights violations, and illegal or dangerous activity.

You may not bypass safety, upload, rate, credit, access, or provider controls; probe or disrupt the Service; scrape it at scale; reverse engineer protected parts of the Service; distribute malware; use bots, scripts, or an unofficial API to submit bulk tasks or defeat usage limits; or use another person's account without authorization.

Generated output

Subject to these Terms and applicable law, FaceSwapGif does not claim ownership of your generated output. Laws concerning AI-generated or transformed material vary, and we do not guarantee that an output is eligible for copyright protection, is unique, or does not resemble third-party content.

You are responsible for reviewing, labeling, publishing, and using outputs. Clearly disclose that content is altered or AI-generated when a reasonable viewer could mistake it for authentic media. Remove content if consent is withdrawn, a person shown objects, or you learn that you lack required rights.

FaceSwapGif may use synthetic samples or separately authorized examples to demonstrate the Service. Your private task is not added to a public gallery merely because it was generated.

Credits, purchases, and refunds

Credits are a limited, revocable license to use eligible Service features. They are not money, cannot be transferred or redeemed for cash, and may expire on the date displayed when they are granted or purchased. The Service consumes credits according to the task type and quality selected before submission.

The pricing page may display beta credit packs before checkout is open. A purchase occurs only when FaceSwapGif presents an enabled checkout flow and you explicitly confirm payment. The checkout screen controls the price, currency, included credits, validity period, taxes, and whether a product is one-time or recurring.

Displayed prices, packages, and credit costs may change for future transactions. A change does not retroactively alter a completed purchase, which remains governed by the checkout terms and policies presented when it was made, subject to applicable law.

If the Service records a generation as failed before successful credit settlement, held credits are ordinarily returned automatically. Stopping result tracking does not necessarily cancel work already submitted to a provider and does not guarantee a credit return. Deleting a completed task or disliking a valid output does not by itself create a refund right.

Unless applicable law requires otherwise, delivered digital credits and completed generation services are non-refundable after use. The Refund Policy explains eligibility, request timing, failed-task credit returns, and the review process. Any recurring product will disclose renewal and cancellation terms before purchase.

Third-party services

The Service depends on hosting, storage, AI generation, authentication, email, analytics, support, and payment providers. Their availability and processing can affect the Service. Your direct use of a third-party sign-in or payment service may also be governed by that provider's terms.

Links to third-party sites do not imply endorsement. FaceSwapGif is not responsible for third-party sites or for uses of an output after it leaves our Service.

Privacy

The Privacy and Cookies Policy explains how we handle account data, uploaded media, provider processing, cookies, retention, and deletion. Do not upload more personal information than is needed for the requested task.

Enforcement, removal, and termination

We may reject or stop a task, remove stored media, restrict features, preserve relevant records, suspend or terminate an account, or report conduct to appropriate authorities when we reasonably believe it is necessary to enforce these Terms, respond to a report, protect rights or safety, prevent fraud or security harm, or comply with law.

Enforcement may occur without advance notice when immediate action is reasonably necessary. You may submit relevant context or challenge an action through Report Abuse or support. We do not guarantee restoration of content or credits when an account or task violates these Terms.

You may stop using the Service at any time. Provisions concerning rights, payments, disclaimers, liability, disputes, and enforcement survive termination where their nature requires it.

Disclaimers

To the extent permitted by law, the Service is provided "as is" and "as available". FaceSwapGif disclaims implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. We do not warrant generation time, provider availability, output quality, accuracy, uniqueness, legal suitability, or permanent storage.

Nothing in these Terms excludes warranties or consumer rights that cannot lawfully be excluded.

Limitation of liability

To the extent permitted by law, FaceSwapGif and its service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, business opportunities, or unauthorized third-party use of content.

To the extent permitted by law, FaceSwapGif's total liability arising from the Service will not exceed the amount you paid to FaceSwapGif for the Service during the 12 months before the event giving rise to the claim. These limits do not apply where applicable law prohibits them.

You agree to defend and indemnify FaceSwapGif against third-party claims, losses, and reasonable costs arising from your content, your use or sharing of outputs, or your violation of these Terms or another person's rights, except to the extent a claim was caused by FaceSwapGif's own unlawful conduct.

Disputes and applicable law

Before filing a claim, contact support@faceswapgif.com and provide enough information for us to try to resolve the issue. These Terms are subject to applicable law and the jurisdiction of courts with authority over the dispute. Nothing in this section removes mandatory consumer protections or rights to use a regulator or court that applicable law grants you.

Changes to these Terms

We may update these Terms as the Service or law changes. The updated Terms will be posted here with a new date. Material changes may also be communicated through the Service. If you continue using the Service after updated Terms take effect, you accept them to the extent permitted by law.
